Prenuptial agreements (also referred to as antenuptial agreements) are contracts entered into by a couple before marriage that determine in advance the relative rights of the individuals to assets and support in the event of death or divorce.

While in years past the use of such agreements was pretty much limited to the rich and famous, a study undertaken by the American Academy of Matrimonial Lawyers recorded an increase in the number of clients seeking prenups, most notably among millennials (defined loosely as individuals born between 1981 and 1996). Pundits opine that the increase is based on a number of factors, including the belief that since millennials are getting married later in life, they have more assets in need of protection including investments, business interests, anticipated family inheritances, and so on. And while the idea of signing an agreement like this may not seem romantic, there is something to be said about the value of addressing and resolving these matters before walking down the aisle.

Prenuptial agreements are legal and enforceable in Michigan provided they meet several requirements, including that they be based on full disclosure by both parties, with each person voluntarily entering into the agreement, without duress or coercion.
