Wright Beamer is proud to announce a recent victory secured by attorneys Evan Chall and Hannah Smith in a hotly contested two-day arbitration.
Wright Beamer represented the manager of two closely-held companies in a case brought by a minority shareholder who asserted shareholder oppression and breach of fiduciary duty claims. The claimant further alleged that the manager received unauthorized management fees and reimbursements and sought to hold him personally liable for attorney fees incurred in defending against the case. (The companies had been paying attorney fees on his behalf.) The arbitration hearing involved extensive documentary evidence, including dozens of exhibits and multiple banker boxes of original records.
After careful review of the evidence, live testimony, and arguments, the arbitrator issued a decision in favor of the manager on all counts, finding no liability on any of the asserted claims and no personal responsibility for payment of attorney fees.
