Michigan Masking Rules Unchanged in the Workplace

Many mask-weary Michiganders breathed a sigh of relief last week when first the CDC, and then Governor Whitmer, announced relaxed mask-wearing rules for fully vaccinated individuals. The Michigan Department of Health and Human Services published a revised emergency public health order on Friday, May 14, consistent with the Governor’s announcement. As of now, however, MIOSHA has not amended its emergency workplace safety rules. That means employers need to continue their existing screening protocols, social distancing policies, and mask mandates.

We can reasonably expect confusion and resistance from workers who do not understand MIOSHA’s primacy in the workplace. While it is possible that MIOSHA will issue revised rules at some point, for now, employers should educate employees about continued adherence to MIOSHA’s rules whether or not someone is vaccinated.
